ASSESSMENTS/DUES - Association has right to suspend voting rights and use of facilities when an assessment remains unpaid and for any infraction of published rules and regulations. Any assessment not paid within 30 days after due date shall bear interest from due date at rate of seven percent per annum. Legal action may be taken for non payment of assessments.

PARK & LAKE AREA EASEMENTS - The Washtenaw County Drain Commissioner has jurisdiction over the park drainage ponds, drainage channels leading to the ponds and the lower portion of lots adjacent to the West Park pond (refer to legal description). These areas were developed for storm water management and flood control. Covenants/restrictions relative to the park area were initiated by the County Drain Commissioner and implemented by the Developer as follows: "Pond lot owners shall maintain easements located on their lot, shall keep grass cut, shall keep area free of trash and debris and take actions necessary to eliminate surface erosions." "In addition, no structure, plantings or other material shall be placed…which may change the direction or flow of drainage in the easements."

LAND USE/BUILDING TYPE - No lot shall be used for other than single-family residential purposes. No building or structure shall be erected, altered, placed, or permitted to remain upon any lot other than one single-family dwelling not exceeding two stories in height.  Each dwelling must have one private, one-story garage for not more than three cars, which must be attached to the residence.  

FENCES - Chain link fences are prohibited. Fences of a visually porous decorous nature, not exceeding four feet in height, are permitted. Exceptions for enclosing in-ground swimming pools are detailed in CCRs.

PETS & ANIMALS - Dogs and cats per residence shall not exceed two cats, two dogs, or one of each. Animals are not allowed to roam freely or become a public nuisance. All other pets shall be kept within residence.

LOT MAINTENANCE - Lots shall be kept trim, mowed and free of debris.

SIGNS - No signs of any kind shall be displayed. Exceptions are "For Sale/Rent" signs, house numbers and residence names.

 

ANTENNAS - Should not be visible from front or side of dwelling and must be approved in advance.

RUBBISH/RECYCLE - Containers shall not be left outside except on regular pick-up days.

LIGHTING - No lighting shall be situated or of such intensity as to create a nuisance to neighboring property.

FIREARMS - No firearms shall be discharged.

RECREATIONAL VEHICLES - No vehicles, boats, trailers, or motorhomes shall be stored outside for more than 72 hours. Nor is any type of recreational vehicle permitted to operate in common areas, and no unlicensed motorized vehicle is permitted to operate on roads.

ARCHITECTURAL  BOARD OF REVIEW - All structures, external alterations or additions must have prior approval of the Board of Directors. Detached outbuildings such as those used for storage will not be permitted. Vertical elements exceeding 20 feet in height (flag poles, bird houses, etc.) shall be permitted only if approved by the Board of Directors.

 

ENFORCEMENT - The Association, or any Owner, shall have the right to enforce, by any proceeding at law or in equity, all restrictions, conditions, covenants, reservations, liens and charges now or hereafter imposed by the provisions of this Declaration. Failure by the Association or by any Owner to enforce any covenant or restriction herein contained shall in no event be deemed a waiver of the right to do so thereafter.
